reasons for decision
- This is an internal appeal under s 80(2) of the Civil and Administrative Tribunal Act 2013 (NCAT Act) against a decision made in the Consumer and Commercial Division of the Tribunal.
- The appellant, a builder, has appealed a decision of the Tribunal made on 29 August 2019. HB 17/51824 was a claim by the homeowner in which orders were made by the Tribunal for the builder to pay the homeowners an amount of $48,946.50. HB 18/08408 was an application by the builder which was dismissed.
- The builder lodged an appeal together with a stay application on 26 September 2019. It is noted that on 10 October 2019 the Appeal Panel made orders, staying the orders of the Tribunal on 29 August 2019 and for the monies ordered to be paid into a trust account
- For the reasons set out below, we have refused to grant leave to appeal and to dismiss the appeal.
The Tribunal Decision
- On 23 May 2017 the parties entered into a contract in relation to the renovation of a bathroom and laundry. The homeowner lodged her application to the Tribunal on 6 December 2017 and was seeking amounts in relation to defective and incomplete works and overcharging. The homeowner was also seeking an order not to have to pay the builder alleged outstanding amounts. The builder's application was for an order for the payment of outstanding amounts of $5,749.13.
