Note: Entry of orders is dealt with in Rule 39.32 of the Federal Court Rules 2011.
On the grounds stated in the statement of claim, accompanying affidavit or other document prescribed by the Rules, the Applicant claims:
- Pursuant to s 545(1) of the Fair Work Act 2009 (FWA) and/or s 21(1) of the Federal Court of Australia Act 1976 (FCAA), a declaration that:
The protected rate of pay for Ms Loretta Bennett is set, for the purposes of s 306F(4) of the FWA, in accordance with the full rate of pay for the Mineworker Level 2 classification under the BMA Enterprise Agreement 2022.
Pursuant to s 545(1) of the FWA and/or s 21(1) of the FCAA, a declaration that:
The respondent contravened s 306F(2) of the FWA in that between 29 September 2025 and 31 October 2025 (or such later date as appropriate) the respondent failed to pay Ms Bennett no less than the applicable protected rate of pay in accordance with the BMA Enterprise Agreement 2022.
- Pursuant to ss 545(1) and (2)(c) of the FWA, an order that the respondent compensate Ms Bennett in the amount of her loss as set out in the Statement of Claim.
- Pursuant to s 546 of the FWA, a pecuniary penalty payable by the respondent to the applicant for contravention of s 306F(2) of the FWA.
- Interest up to judgment.
- Such further or other orders as the Court deems fit.
- Which proceeding was commenced first.
- Whether the termination of one proceeding is likely to have a material effect on the other.
- The public interest.
- The undesirability of two courts competing to see which of them determines common facts first.
- Consideration of circumstances relating to witnesses.
- Whether work done on pleadings, particulars, discovery, interrogatories and preparation might be wasted.
- The undesirability of a substantial waste of time and effort if it becomes a common practice to bring actions in two courts involving substantially the same issues.
- How far advanced the proceedings are in each court.
- The law should strive against permitting multiplicity of proceedings in relation to similar issues.
- Generally balancing the advantages and disadvantages to each party.
I certify that the preceding sixteen (16) numbered paragraphs are a true copy of the Reasons for Judgment of the Honourable Justice Collier.
