(a) The first was that, in summary, at the time of the events the system mandated an approach to vaccination that took away from foundational ethical principles.
(b) The second was that, with hindsight and what we know today, his position about the system has been proven to be correct.
(a) there is a six-volume hearing book in evidence (which relates to all allegations);
(b) it contains numerous statements by Dr Nixon, including statements on his website, statements he has made in interviews and statements he has self-published;
(c) those statements include that he has, from 2022,[1] engaged in research into the COVID-19 Pfizer vaccine. He has also told the Ahpra investigators that he had been doing this when he was interviewed in August 2024;
(d) there is no evidence that he has obtained any approval or consent for this research.
(e) there are also videos of presentations he has given about the nature of the COVID-19 vaccine;
(f) much of this material, that is, the written statements and some of the links to some of the material in the interviews, is contained on his website;
(g) Dr Nixon does not dispute the factual aspects of these matters.
[1] The Tribunal accepts Dr Nixon's statement that the reference in one of his papers to 'from 2021 onwards' was an error and makes a finding that it occurred from 2022.
