The application is amended by substituting as applicant the Medical Board of Australia.

The Tribunal finds that the respondent has engaged in "unprofessional conduct" of a serious nature within the meaning of the Medical Practice Act 1994 and "professional misconduct" within the meaning of the Health Professions Registration Act 2005.

The respondent is disqualified from applying for registration under section 4 of the Health Professions Registration Act 2005 within a period of two years from 1 September 2010.

This order comes into effect on 1 September 2010.
