[2016] VCAT 841
Victorian Civil and Administrative Tribunal
2016-05-25
Original judgment source is linked above.
[1] McSteen v Architects Registration Board of Victoria [2016] VCAT 291.
[2] VCAT is conducting a de novo review of the decision of a tribunal appointed by the respondent (the Board) to conduct an inquiry under s 18 of the Act. VCAT stands in the shoes of the tribunal which conducted that original inquiry (s. 42 of the Act). As with the original tribunal, VCAT's powers concerning findings and determinations are set out in s 32 of the Act.
[3] Hannebery v Legal Ombudsman [1998] VSCA 142.
[4] Quinn v Law Institute of Victoria Limited [2007] VSCA 122 at [30].
[5] Law Institute of Victoria v Brott [2008] VCAT 1998 per Ross J.
[7] Some of which was not copied to the Board by Mr McSteen's representatives.
[8] Of course the obligation to comply with the rules of natural justice falls on the Tribunal, rather than the Board - s 98(1)(a) of the VCAT Act.
[9] [2012] HCA 17 (3 May 2012) per French CJ, Gummow, Hayne, Crennan, Kiefel and Bell JJ..
