DECISION
- James McFadyen was employed with the Lord Howe Island Board ("Board"). His duties included conducting inspections of the airport on Lord Howe Island. On the weekend of 5 and 6 November 2022, Mr McFadyen failed to carry out the inspections he had been rostered to perform. He subsequently created records which created the impression that the inspections had in fact been conducted. His employment was terminated following a finding that his conduct amounted to misconduct.
- Mr McFadyen challenged his dismissal, filing an application pursuant to s 84 of the Industrial Relations Act 1996 ("IR Act"). He seeks an order reinstating him to his employment.
