- The plaintiff, Rolah Ann McCabe, on 26 October 2001 commenced proceeding number 8121 of 2001 in this Court against the defendant, British American Tobacco Australia Services Ltd ("BATAS") seeking damages for personal injury. On 22 March 2002 Eames J published his reasons for striking out the defence of BATAS and directed that the trial proceed as an assessment of damages. The trial is over and the matter has moved on to the Court of Appeal.
