CITATION Maynard & Anor v Deklerk & Anor [2025] VBAB 82
Having considered all the submissions and information placed before it, the Building Appeals Board (BAB) determines and orders pursuant to s 161 of the Building Act 1993 (the Act), as follows:
(a) the National Construction Code, 2019 edition, Volume 2 (NCC 2019 Volume 2) to the extent that the Party Wall is affected by the building work carried out in around 2020 on 45 Connolly Avenue, Coburg to create the attic storage room, as well as any further building work required to be carried out as a result of this finding; and
(b) in particular, Part 3.8.6, Sound Insulation, of the NCC 2019 Volume 2 to the extent that the Party Wall is affected by the building work at 45 Connolly Avenue, Coburg.
(a) the precise scope of building work required to be carried out to give effect to the findings in orders 1 and 2 above;
(b) relevant design documentation such as drawings, computations, performance solutions and certification for such building work;
(c) the cost of such building work;
(d) how much of the cost of the building work is to be met by each of the owners; and
(e) the timing of such building work.

For the Respondent In person and Ghazi Zoghaib, solicitor for Respondents
(a) the construction of the Party Wall; and
(b) how much of the cost of construction of the Party Wall is to be met by each of the owners.
(a) a building order to stop building work dated 22 July 2024 pursuant to s 112 of the Act;
(b) an emergency order dated 22 July 2024 pursuant to s 102 of the Act;
(c) a building notice dated 22 July 2024 pursuant to s 106 of the Act; and
(d) a building order dated 8 November 2024 pursuant to s 111 of the Act (Building Order).
(a) a design drawing of the 'Proposed Attic' at No. 45 dated April 2023 prepared by Scenic Design and Drafting Pty Ltd (Scenic Drawing);[1]
(b) structural engineering drawings numbered S101, S201, S202 and S401 dated 24 April 2024 prepared by Tebbs Engineering;[2]
(c) Certificate of Compliance for Proposed Building Work dated 12 September 2024 prepared by James Jonathan of Tebbs Pty Ltd;[3]
(d) Fire Engineering Performance Based Design Brief dated 19 November 2024 prepared by DDEG (Fire) (DDEG) (Fire PBDB).[4]
(a) the Scenic Drawing contains a note with an arrow to the ends of the Beams exposed within No. 47 stating:
Provide 50mm thick Bradford Fireseal insulation batts to seal the cavity wall at the ends of timber beam penetrations including the original hanging beams.
(this is referred to below as the Scenic fire specification)
(b) the Scenic Drawing contains no sound insulation treatment for the Party Wall;
(c) the Fire PBDB purports to provide a BCA performance solution with respect to the Beams penetrating the Party Wall, such that the Beams would be permitted to be retained in their current state, provided that all gaps between the timber and the masonry are sealed with a fire rated sealant (DDEG Performance Solution).[6]
(a) 2 x 13mm Gyprock Fyrcheck plasterboard to the face of the single skin of the Party Wall from within the No. 47 attic space;
(b) 70mm x 45mm studs in front of the plasterboard referred to in (a) above with R2.0 insulation;
(c) 2 x 13mm Gyprock Fyrcheck plasterboard attached to the studs referred to in (b) above, extending 400mm into the cavity of the Party Wall to cover the Beams; and
(d) non-combustible insulation blown into the Party Wall cavity below the ceiling level.
Building work to alter an existing building must comply with these Regulations.
(a) with an FRL of 60/60/60; and
(b) to the extent that the Building Work affects it, in accordance with the sound insulation requirements contained in Part 3.8.6 of NCC 2019 Volume 2.
(a) the building work required to achieve the required fire separation should not affect or limit the usage in the future of the attic space in No. 47;
(b) while clause 3.8.6.3(a) of the NCC 2019 Volume 2 sets out two alternative methods of complying with Part 3.8.6 of NCC 2019 Volume 2, we note that it may well be more economical to comply with the requirements in clause 3.8.6.3(a)(ii) than using results from laboratory experiments;
(c) the building work required to achieve the required fire separation and the required sound insulation could be combined, as is the case in the Applicants' Proposal, or could be dealt with separately. Further, the required sound insulation is likely to be able to be constructed on either side of the Party Wall. However, we note that the cause of the requirement for the Party Wall to comply with the NCC 2019 Volume 2 is the Building Work, and therefore prima facie it appears to us logical that this work be carried out on No. 45 by the Respondents;
(d) the costs provided by the Applicants in support of the Applicants' Proposal include costs associated with obtaining performance solutions pursuant to the BCA. It appears to us that it may not be necessary to obtain performance solutions in order to demonstrate compliance with the NCC 2019 Volume 2;
(e) submissions should also address the proposed timing of the building work.
[3] Noting that it appears that much of the building work certified was carried out as part of the Building Work, and therefore is not 'proposed'.
