Ruling: The defendant pay the plaintiff's costs on a standard basis, and any reserve costs, on a standard basis, to be assessed by the Costs Court in default of agreement.
(a) The property at Drouin South be placed on the market for sale;
(b) All necessary sale costs and unpaid rates be paid from the sale proceeds;
(c) The defendant receive an amount of $89,000 from sale proceedings in acknowledgment of his addition of the barn to the property;
(d) The net sale proceeds be paid into the residue of the Estate; and
(e) From the residue of the Estate the plaintiff be paid 30% in full settlement of her entitlement under the Will and inclusive of costs.
Per Rule 26.08:
(2) Where an offer of compromise is made by a plaintiff and not accepted by the defendant, and
the plaintiff obtains a judgment on the claim to which the offer relates no less favourable to
the plaintiff than the terms of the offer, then, unless the Court otherwise orders, the plaintiff
(b) in the case of any other claim of the plaintiff, to an order against the defendant for the
plaintiff's costs in respect of the claim before 11.00 a.m. on the second business day after the
offer was served, taxed on the ordinarily applicable basis and for the plaintiff's costs thereafter taxed on an indemnity basis.
(a) It was not unreasonable for him to reject the plaintiff's offer of compromise;
(b) An order for indemnity costs will substantially reduce the residue of the estate which will fall solely on the defendant; and
(c) It was not clear from my reasons that the Court has considered the defendant's entitlement to an agreed $84,000 and the award to Ms Gair of $270,000.
(a) The offer of compromise made by the plaintiff was not for a fixed sum, but for a percentage of the final value of the estate after sale of the Drouin South property and after taking out the value of the barn at $89,000. It was an offer inclusive of costs;
(b) At trial, the plaintiff sought, and was awarded a fixed sum, in addition to the provision of $100,000 under the will;
(c) A direct comparison of the offers against the award at trial is difficult given that like is not being compared with like; and
(d) The reasonableness of the rejection of the plaintiff's offer is a relevant factor.
