The subject land (being the former Tye Estate) is located about 6 km south-west of Romsey, north of Melbourne. It is about 440 hectares in area, located in the foothills of the Mt Macedon region. It is very undulating and heavily treed. The Bolinda Creek crosses the southern corner of the property. The various buildings now used for the Candlebark School are located at the southern end of the site and accessed via Kerrie Road which is a dirt road.
On 28 March 2012, the Tribunal inspected the site and surrounds. This included driving the length of Kerrie Road, looking inside the school library and inspecting the school campus on foot.
Nature of site/school and summary of previous Tribunal proceedings
together meant that "...the school's basic features give it an inherently high bushfire risk"[4].
Based on the information currently before me, I can indicate in principle that if the bushfire risk and school bus issues are reviewed and resolved at a future stage so as to reach an acceptable planning outcome, then the Tribunal does not see any other planning obstacle to allowing the proposed new "196 student" cap.
Revised Section 87A Application lodged in May 2011 and hearing process in 2012
SCOPE OF TRIBUNAL'S DISCRETION WITH FRESH PROCEEDING
An earlier decision should be taken into account and given great weight. It could be said that the earlier decision should not be changed unless the applicant can show a change in circumstances which warrant a different view.
In the case of a different but similar application which has been prepared in accordance with the advice of the Board, equity or fairness demands that considerable weight be given to the fact that the applicant has endeavoured to accommodate suggestions as to what would be appropriate.
Based on the information currently before me, I can indicate in principle that if the bushfire risk and school bus issues are reviewed and resolved at a future stage so as to reach an acceptable planning outcome, then the Tribunal does not see any other planning obstacle to allowing the proposed new "196 student" cap.[7]
SHOULD THE TRIBUNAL BE APPLYING THE BMO OR THE WMO?
To assist to strengthen community resilience to bushfire.
To identify areas where the bushfire hazard requires specified bushfire protection measures for subdivision and buildings and works to be implemented.
To ensure that the location, design and construction of development considers the need to implement bushfire protection measures.
To ensure development does not proceed unless the risk to life and property from bushfire can be reduced to an acceptable level.
The requirements of the Wildfire Management Overlay in Clause 44.06 of this scheme in force immediately before 18 November 2011 continue to apply to any planning permit application lodged before this date.
The requirements of Clause 44.06 Bushfire Management Overlay of this scheme do not apply to:
