This is a dispute between two manufacturers of shelving systems. Their products are substantially identical in erpearance, form, composition, and function. They are interchangeable. Neither manufacturer has any relevant protection for its product by registered patent, trade mark or industrial design. The applicant, Marlbro Shelving Systems Pty. Limited (to which I shall refer as "Marlbro"), is the proprietor of the registered trade mark "Marlbro" in connection with class 6 goods covering shelving, but the name "Marlbro" does not appear on the product itself and no complaint is made in these proceedings in relation to the
