- This matter comes before me by way of an appeal from the orders of a Master of the court made on 28 May 1999. It is unnecessary to recite the orders at this stage of my reasons for judgment. In due course I shall do so.
- At the outset I should say that I have gleaned some of the matters referred to in my reasons for judgment not from the documentation in this proceeding but from two applications in a proceeding before the Family Court of Australia involving the plaintiff, Bonnie Averill Malherbe (Mrs Malherbe) on the one hand and her husband, the second-named defendant, Samuel Francis Malherbe (Mr Malherbe) on the other (proceeding No.5173 of 1999), an order of that court of 25 May 1999 and certain matters which were told to me by counsel for the parties during the course of the hearing and which were not the subject of any dispute.
