s.394 - Unfair dismissal

Application for an unfair dismissal remedy - decision revoked

[1] On 28 January 2026, I issued a Decision [[2026] FWC 44] dismissing Mr Whitehouse's application for an extension of time to pursue an unfair dismissal remedy. After the Decision was issued, Mr Whitehouse provided additional information that I considered necessitated a hearing be conducted in relation to whether an extension of time should be granted.

[2] Under s.603 of the Fair Work Act 2009 (Cth), the Commission may revoke a decision of the Fair Work Commission on its own initiative or by application by a person who is affected by the decision.

• [3] On my initiative, I have decided to revoke the Decision.[1]

• [4] The Decision and Order made in matter number U2025/19985 (PR795550) is revoked. The matter is remitted for reconsideration. An Order[2] to this effect is issued with this Decision.

[5] Order [4] shall operate on and from 6:00pm (AEDT) on 28 January 2026.
