[2012] VCAT 481
Victorian Civil and Administrative Tribunal
2012-04-17
Original judgment source is linked above.
In accordance with section 25(b) and (c) of the Freedom of Information Act 1982 (Vic), I request that in your decision to release documents, that you include copies of all documents, incoming and outgoing correspondence, internal correspondence, referrals, staff notes, memos, reports, books, papers, records, assessments, record of telephone communications, personal information, general file information and any other documents or things stored physically or electronically which are in the possession of Peninsula Health, the Frankston Hospital and their contracted service providers and which make up my records, which, with deletions, would make the copies not exempt documents.
(a) a decision is made not to grant a request for access to a document on the ground that it is an exempt document or that to grant the request would disclose information that would reasonably be regarded as irrelevant to the request;
She does not make any request under that sub-section at all. Therefore, I find that her request for internal review does not go to the documents where exemption was claimed and I will make orders in defining that parameter of that proceeding accordingly. I have said I will adjourn that proceeding in any event.
