- This is an appeal from the decision of Commissioner Muir in Local Government Engineers Association of New South Wales v MidCoast Council [2021] NSWIRComm 1081 ("Decision").
- The Application for Leave to Appeal and Appeal identified both the Local Government Engineers' Association of New South Wales ("LGEA") and the New South Wales Local Government, Clerical, Administrative, Energy, Airlines & Utilities Union ("USU") as the appellants. However, while the USU appeared at the hearing, it did not separately file or make submissions. Written and oral submissions were advanced by the LGEA. It follows that while we will reference in this decision the position put by the LGEA, we have not overlooked the interest of the USU in these proceedings. We have assumed that the USU supports the position advanced by the LGEA.
