Livingstonia [2025] QBCCMCmr 342
Peter Bath and Judith Young, proprietors of Lot 66 (applicant)
Section 79 of the Building Units and Group Titles Act 1980 (Qld) (Act)
IMPROVEMENT TO COMMON PROPERTY - where a 'Florida room' associated electrical conduit installed on a lot encroach onto common property - whether the proprietors' proposal for retrospective consent for an alteration to common property was unreasonably refused -
COSTS - whether costs should be awarded against the applicants.
That the respondent body corporate consents to the proposal by the applicants set out as Motion 10 in the agenda for its Annual General Meeting held on Wednesday 26 February 2025.
It was objectively unreasonable to tolerate the presence on common property of identical awnings yet refuse to allow it in this one case, despite the lack of any evidence that this installation would cause problems that the others had not.
