Following its consideration of submissions and evidence, the Panel reached the following key conclusions:
The key issue discussed during the Hearing was the flooding of the Inverloch-Venus Bay Road that provides the only road access to Venus Bay. The WGCMA submitted that flooding of this road was a significant community hazard and because of this no additional residential lots should be created in Venus Bay.
Although the Panel acknowledges the WGCMA's concerns, it has had to assess the nature, frequency and extent of the flood risk, and have regard [to] risk to management strategies and the small number of additional lots that will be created. The Panel has also had regard to the broader community benefits that might result from the proposal and concluded, on balance, that it should proceed.
Section 173 agreement
GRIEVANCES ABOUT COUNCIL'S PROCESSING OF THE APPLICATION
[1] Subsequent to the application for review being lodged with the Tribunal, the subject land has been identified as an area of Aboriginal cultural heritage sensitivity. This was raised at the start of the hearing by myself and Mr Berger. At the hearing, I indicated that I agree with the Council's submission that the proposal is for two dwellings on each of separate and disposable lots. Each dual occupancy is designed as a separate project; they stand alone on each lot. I formed the view that the exemptions under the Aboriginal Heritage Regulations 2018 apply.
