1 By summons dated 23 September 2008, the appellants seek relief of two kinds. First, they seek an order under rule 64.16(2)(a) that their appeal shall be taken not to be abandoned. The deemed abandonment occurred because of the late filing of the appeal book. This order is not opposed, and will be made.
