Legal Services Commissioner v Adamakis (Legal Practice) [2013] VCAT 1970
...beyond protection of the public to include the legal profession as a group, the courts, the justice system and community confidence in that system.
Issues arising from the non-attendance of the respondent
The reasons for not attending a hearing of this nature, arising out offences of this type, may be manifold. The Court should be slow to draw any conclusive inferences from such a decision. It may result from a disregard for a lawyer's obligations to the Court, equally it may be the result of shame.
In a case in which no effort has been made to contact the court in any fashion, I am more inclined to believe that it is the result of something approaching the former of these two concepts. At the very least, it bespeaks a disturbing degree of indifference to the seriousness of the application which I am required to decide upon. It suggests that the individual does not properly understand or take seriously their obligations to the court.....
As you can imagine I would like this issue to be resolved as soon as possible however unfortunately I have been confronted with situations which have been out of my control...
Whilst I acknowledge the mistakes I have made in the past I would like to move forward....
Given my dire circumstances I would ask if you please adjourn this matter for late October....
In that year, it became apparent that a car accident Irene had been involved in about that time had affected her. The writer's recollection is that she needed some time off from work to make a full recovery and that is the reason she ceased employment.
The entire administration of justice in any community which is governed by law depends on the honest working of legal practitioners who can be relied upon to meet high standards of honesty and ethical behaviour.
