Davie v Manuel [2024] WASCA 21; (2024) 107 MVR 147
Union Steamship Co of New Zealand v The Caradale [1937] HCA 1; (1937) 56 CLR 277
(a) That, without reasonable grounds and where he ought to have known he lacked reasonable grounds, Mr Barker made and repeated allegations of dishonesty and criminal conduct against another lawyer (Ms L): Ground One;
(b) That, without reasonable grounds and where he ought to have known he lacked reasonable grounds, he lodged for filing in the Family Court of Western Australia (FCWA) letters in which he alleged that the FCWA had ignored or refused to address criminal behaviour and that the FCWA had engaged in behaviour which amounted to (or would do so if it failed to accept his application) a perversion of the course of justice. Amongst other things, in those letters he alleges (in broad terms) misconduct against an independent children's lawyer (Ms K): Ground Two; and
(c) That, without reasonable grounds and where he ought to have known he lacked reasonable grounds, he made allegations of criminal conduct, corruption and/or misfeasance by the Board or its representatives: Ground Three.
Although sometimes expressed in terms referring to a necessity for a hearing, the fundamental requirement of procedural fairness is (relevantly for present purposes) that a party is given a reasonable opportunity to be heard, in other words, to present their case by evidence, information and submissions. However, the requirements of procedural fairness are not fixed or immutable. Procedural fairness is directed to avoid practical injustice, and what is necessary to avoid practical injustice will depend upon the circumstances.[2]
(a) The first is an affidavit of Mr Barker dated 5 June 2025 and originally filed in VR 20 of 2023, headed '[Ms L's] fabrication of evidence';
(b) The second is an email dated 9 March 2026 from Mr Barker to an officer of the Board which amounts to a series of allegations of misconduct against three other legal practitioners - Ms L, Ms K and Mr H (who appears to have acted for Ms K); and
(c) The third appears to be a summary of an affidavit filed with the FCWA on 20 November 2025 which, again, amounts to a series of allegations of misconduct against the same three legal practitioners.
(a) an application he has made to the Supreme Court under the Vexatious Proceedings Restriction Act 2002 (WA) (VPRA);[5] and
(b) an appeal he proposes to bring against a recently made Family Violence Restraining Order (FVRO).[6]
(a) as of right by the Attorney General and the Principal Registrars of each of the Supreme and District Courts; and
(b) by a person 'against whom another person has instituted or conducted vexatious proceedings' or 'who has a sufficient interest in the matter' but only with the leave of the Court.
(a) As to the VPRA proceedings, the Court is yet to grant leave to commence proceedings and, as Mr Barker acknowledges, if leave is granted the application 'is pushing the law';[24] and
(b) As to the FCFCoA appeal, I have nothing before me to say that an appeal has in fact been commenced and, even if it has, its subject matter (the grant of an FVRO) does not appear well suited to achieve Mr Barker's aims of exposing illegality by, amongst others, his ex-wife's solicitor.
I certify that the preceding paragraph(s) comprise the reasons for decision of the State Administrative Tribunal.
