s.120 - Redundancy pay
Variation to redundancy pay - parties agreed on fair amount - application granted
[1] At a mention hearing earlier today, I decided to grant an application by Lantrak Management Pty Ltd (Lantrak) under s 120(2) of the Fair Work Act 2009 (Cth) (Act) to reduce the redundancy entitlement of its employee, Leanne Aparo, to an amount that the parties had agreed upon following discussions at the hearing. The agreed amount was 6 weeks' pay, but on the understanding that Lantrak would terminate Ms Aparo's employment by paying her 4 weeks' pay in lieu of notice, such that her combined redundancy and notice payment would be an amount reflecting 10 weeks' pay. Subject to this condition, I determined pursuant to s 120(2) of the Act to reduce the amount of redundancy pay to which Ms Aparo is entitled under s 119 of the Act to the agreed amount of 6 weeks' pay ($3415.95), which I considered to be an appropriate amount.
