[2023] FWC 2681
defendant. Application dismissed
1 cited instrument linked from this judgment.
The Fair Work Commission dismissed an unfair dismissal application because the employee had not worked for the employer long enough to be eligible to make such a claim. Under the Fair Work Act, employees must generally complete 6 months of employment (or 12 months for small businesses) before they are protected from unfair dismissal. This employee had only worked for about 2.5 months. The Commission tried to contact the employee several times to explain this and give them a chance to provide any evidence that might help their case, but the employee did not respond. Because the employee clearly did not meet the minimum employment period requirement, the Commission found the application had no reasonable chance of success and dismissed it.
