of Certain Rules for International Carriage by Air done at Montréal on 28 May 1999 ["1999 Montreal Convention"] . The Applicant's purchase of a ticket is significant in that under Article 1(1) the 1999 Montréal Convention applies to "all international carriage of persons, baggage or cargo performed by aircraft for reward".
The carrier is liable for damage sustained in case of death or bodily injury of a passenger upon condition only that the accident which caused the death or injury took place on board the aircraft or in the course of any of the operations of embarking or disembarking.
In the carriage of passengers, baggage and cargo, any action for damages, however founded, whether under this Convention or in contract or in tort or otherwise, can only be brought subject to the conditions and such limits of liability as set out in this Convention without prejudice to the question as to other persons who have the right to bring suit and what are their respective rights. In any such action, punitive, exemplary or any other non-compensatory damages shall not be recoverable.
[1] Section 9B of the Carriers' Liability Act: "Subject to this Part, the 1999 Montreal Convention has the force of law in Australia in relation to any carriage by air to which the 1999 Montreal Convention applies, irrespective of the nationality of the aircraft performing that carriage".
[2] Section 9E of the Carriers' Liability Act: "Subject to section 9F [which is irrelevant to this case] the liability of a carrier under the Convention, in respect of personal injury suffered by a passenger that has not resulted in the death of the passenger, is in substitution for any civil liability of the carrier under any other law in respect of the injury".
