Defamation - Whether imputations in statement of claim open - Not capable of being defamatory. Defence - Polly Peck plea - Particulars of claimed justification insufficient.
- I do not intend to write extended reasons on this application. The debate is to be found in the transcript. There are two applications: one by the plaintiffs and one by the defendant. The plaintiffs' summons of 4th December 1998 is a summons to strike out paragraph 9 of the defendant's defence although essentially it is a summons for further and better particulars of the defence, the failure to deliver which has led to the strike-out application. The defendant's summons of 7th December 1998 is to strike out paragraphs 5(b)(i) and 6(b)(i) of the plaintiffs' amended statement of claim.
