HALL INFANTE and Minister for Immigration and Citizenship (Migration) [2025] ARTA 2655 (1 December 2025)
Respondent: Minister for Immigration and Citizenship
Decision: The Tribunal sets aside the decision under review and in substitution decides that the cancellation of the applicant's visa be revoked.
Written reasons for this decision will be provided within seven days hereof.
........................................................................
MIGRATION - mandatory cancellation of visa - whether 'another reason' to revoke cancellation under section 501CA(4)(b)(ii) of Migration Act, 1958 (Cth) - applicant recidivist offender with substantial past drug-dependence issues - country of removal Chile from which applicant departed when aged 5 - interests of minor child - child not in care of mother - removal of biological father very serious in circumstances - responsible Government agency stresses importance of contact with father - decision set aside in unusual circumstances of case
Migration Act 1958 (Cth)
Khalil v Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs [2025] HCA 33
Minister for Immigration, Citizenship and Multicultural Affairs (Cth), Direction no. 99 - Visa refusal and cancellation under section 501 and revocation of a mandatory cancellation of a visa under section 501CA (25 January 2023)
Minister for Immigration, Citizenship and Multicultural Affairs (Cth), Direction no. 110 - Visa refusal and cancellation under section 501 and revocation of a mandatory cancellation of a visa under section 501CA (7 June 2024)
The Department considers it important for [B] to have contact, where possible, with his father and will continue to work with Mr Hall Infante to facilitate this. To enable [B] to continue to establish and develop an ongoing and sustainable relationship with his father, it is strongly preferred that Mr Hall Infante remain resident in Western Australia. The Department is of the opinion that it is of critical importance for a child's developing sense of identity that he has ongoing and consistent contact with his biological family, preferably on a face-to-face basis.[50]
I certify that the preceding ninety-four (94) para-graphs are a true copy of the reasons for the decision herein of Senior Member Manetta.
