1. The appellant pay the costs of the respondent before the Magistrate and the costs of this application for costs.
1. This is an application for costs following a successful appeal to the Federal Court against my ruling on 22 December 1999 that there is no power in this Court to review an order for costs made by the Magistrates Court upon the dismissal of an information. When the application for review was before me the power was sought to be invoked by the provisions of s 219B of the Magistrates Court Act 1930 (the Magistrates Court Act). The Federal Court agreed that that section does not confer a power to review a costs order made by a magistrate consequent upon a dismissal of an information but held that an alternative source of power is to be found in s 20(1)(a) of the Supreme Court Act 1933 (the ).
