The Administrative Appeals Tribunal found that a visa applicant satisfied the requirement of having an 'approved nomination' for a Subclass 187 visa, even though the nomination had originally been refused by a government delegate. The Tribunal itself had separately reviewed and approved the nomination on 24 April 2023. Because the nomination was now approved, the key obstacle to the visa was removed. Rather than deciding all remaining visa criteria itself, the Tribunal sent the application back to the Department of Home Affairs to check any other requirements. The applicant's family members, who were included in the application, will also have their cases considered when the application is reviewed again.
