Original judgment source is linked above.
I write to notify the Tribunal that Respondent is informed that the Appellant has been incarcerated and will still be in custody at the time of the appeal hearing on 13 August 2025. I note that the Appellant contacted Homes NSW to advise that she will not be able to attend the appeal hearing.
The Respondent is not aware of any adjournment request made by the Appellant to the Tribunal. However, for the Tribunal's consideration when determining how the matter should proceed in these circumstances, the Respondent seeks that the appeal proceeds with the hearing on 13 August 2025 on the basis that the Respondent needs and is entitled to finality of proceedings. The Respondent notes that the orders at the subject of the appeal were made on 24 March 2025 and the length of proceedings has caused the Respondent significant financial detriment, as noted by Senior Member Hennings in the written decisions for the orders made on 8 April 2025 (attached).
To that end, the Respondent would not oppose a virtual appearance by the Appellant. It is noted that the Appellant's evidence for the appeal is already lodged with the Tribunal and provided to the Respondent.
I would be grateful if you could please advise if there are any changes to the hearing listed on 13 August 2025.
The Appellant is copied into this correspondence.
(1) The Landlord's submissions in support of it being allowed legal representation with attachments.
(2) Those attachments included the Tenant's earlier refusal to consent to legal representation.
(3) An email from the landlord consenting to a short adjournment to no later than 18 August 2025.
1 The adjournment request will be considered at the commencement of the hearing.
2 The respondent's request for legal representation is refused with reasons reserved.
(1) A hearing on the issue of the whether the New South Wales Land and Housing Corporation should be given leave to be legally represented is dispensed with.
(2) Leave for the New South Wales Land and Housing Corporation to be legally represented is refused.
I hereby certify that this is a true and accurate record of the reasons for decision of the Civil and Administrative Tribunal of New South Wales.
