Kararmaz v Rural City of Murray Bridge [2022] SACAT 87
The applicant sought review of a decision by the Ombudsman affirming a decision made by the Rural City of Murray Bridge under the Freedom of Information Act 1991 (SA) ('FOI Act'). The applicant sought access to documents relating to an incident in which she was bitten by a dog. Five documents were identified by the council to fall within the scope of the request. The decision (as affirmed by the ombudsman) granted full access to documents two and four, partial access to documents one and three, and refused access to documents four and five. The applicant sought access only to the part of document three that contained the name and contact details of the dog owner.
The applicant submitted that disclosure of the information sought would be reasonable, given her special interest in the content. The respondent submitted that disclosure of the information sought would be unreasonable because the applicant's special interest does not override the need to preserve personal privacy.
