- These proceedings arise out of a refusal by the respondent Council of a development application lodged on 7 September 2000 which sought the construction of a three storey residential flat building of 15 x 2 bedroom units and 25 car parking spaces at No 264 Bunnerong Road, Hillsdale. The proceedings were commenced on 22 January 2001 on the basis of the application being a "deemed refusal", but it was ultimately refused by the Council on 30 April 2001.
- The applicant in these proceedings had prosecuted an appeal in this Court, heard by Commissioner Roseth on 2 June 2000, in respect of the same property. The proposal, the subject of that appeal, was for a three storey apartment building of 18 dwellings. That proposal had a floor space ratio ("FSR") of 1.3:1; the Commissioner accepted that the permitted FSR under the LEP was 1:1, and found that the increase to 1.3:1 was not justified. For this reason he refused the appeal.
