Judgment (192 paragraphs)
Introduction
- COMMISSIONER: This is an appeal pursuant to s 97 of the Environmental Planning and Assessment Act 1979 (the Act) against the refusal by Hunters Hill Council (the Council) of Development Application 2005/1177 to demolish the existing dwelling located on 38 Earl Street, Hunters Hill (the site).
- In place of the existing house, the applicants propose to erect a part one and part two storey building, with the new building proposed to be used as a long day childcare centre for 50 children. An open car parking area for 3 cars would be provided in the front of the site.
- The centre is to have seven permanent childcare staff (2 qualified teachers, 3 qualified advanced childcare workers and 2 unqualified advanced childcare workers). In addition, there would be a permanent part-time cook in the mornings and a centre director, who would not be located permanently at the site but who would visit from time to time as required.
