Kafataris v Bookmakers & Bookmakers' Clerks Registration Committee (Occupational and Business Regulation) [2008] VCAT 577
Dr T McEvoy, instructed by the Victorian Government Solicitor.
(i) Each side was represented by senior and junior counsel;
(iii) The manner in which the hearing was conducted was one far more similar to the way in which litigation would be conducted in a court than to the manner in which many cases are conducted before this Tribunal;
(iv) An issue of considerable significance and importance was involved.
Thus, when one considers the factors raised pursuant to s.109(3)(d) and (e), and there is considerable overlapping, it seems to me that what could be described as the presumption pursuant to s.109(1) has been displaced. Kafataris is entitled to his costs, including those reserved costs which have effectively become costs in the cause.
