Lundberg J
Original judgment source is linked above.
(These reasons were delivered ex temporaneously and have been edited from the court's record of the decision.)
(a) First, the Administrator seeks judicial advice in connection with proceedings in this court which have been brought by a third party (Mr Loren Ross Bywaters) against both the Administrator and Mr Iannaccone. The Administrator seeks an order that he would be justified in defending the claims pleaded against him. I will refer to the proceeding (being CIV 1418 of 2025, which is being case managed by Howard J), as the Estate Proceeding.
(b) Second, the Administrator seeks judicial advice in connection with a prospective claim against Mr Bywaters, for recovery of a loan alleged to have been made by the deceased to Mr Bywaters on or about 2 December 2022, in the amount of $140,000. The Administrator seeks an order that he would be justified in commencing a counterclaim in the Estate Proceeding, or fresh proceedings in the District Court of Western Australia, to recover the loan. I will refer to this prospective claim as the Loan Claim.
Section 92 of the Trustees Act
(1) Any trustee may apply to the Court for directions concerning any property subject to a trust, or respecting the management or administration of that property, or respecting the exercise of any power or discretion vested in the trustee.
(2) Every application made under this section shall be served upon, and the hearing thereof may be attended by, all persons interested in the application or such of them as the Court thinks expedient.
The Estate Proceeding Summary of the proceeding
(a) the Administrator observing and maintaining a supporting role with respect to Mr Iannaccone's defence of the estoppel allegations (on common questions such as whether the promises were made and relied upon) to the extent required to remain satisfied that Mr Iannaccone's defence on these matters is sufficient to protect the interests of the Beneficiaries as a whole; and
(b) defending the allegations, and addressing arguments and evidence, that pertain more specifically to the claim against the Estate for equitable compensation.
(a) that the deceased in fact made the alleged representations;
(b) that the words spoken gave rise to a sufficiently clear and unequivocal promise; and
(c) that Mr Bywaters relied upon the alleged promise to his detriment; that is, but for the promise, he:
(i) would have pursued better employment opportunities elsewhere; and/or
(ii) would have purchased other properties and obtained capital growth; and/or
(iii) would not have spent money making improvements to the Burekup Property.
I certify that the preceding paragraph(s) comprise the reasons for decision of the Supreme Court of Western Australia.
