Application under Section 77 of the Planning and Environment Act 1987 (the Act) to review a decision to refuse a permit. Major Promotion Sign
Iom Pty Ltd v Maroondah CC [2012] VCAT 1705
Pole mounted, externally illuminated major promotion sign. The sign is proposed to have two faces and a V - shaped configuration. Each face of the sign has an area of 86.78 m2 (total advertising area of 173.56 m2). The sign will be erected above a 10 m high pole and will have a total height of 15.17m. It is proposed to locate the sign to the rear of an industrial building facing the Eastlink freeway.
Application under Section 77 of the Planning and Environment Act 1987 (the Act) to review a decision to refuse a permit
Advertising sign requirements are at Clause 52.05. This zone is in Category 2 (Office and Industrial - low limitation).
Clause 52.05-8: A permit is required to display a major promotion sign.
The review site is located in an industrial area on the western side of Eastlink, about 240 m north of the Canterbury Road on ramp. The site comprises five industrial buildings. The sign is proposed to be located on vacant land to the rear of those buildings, facing Eastlink.
Will the proposal achieve an acceptable outcome having regard to the policies and provisions of the planning scheme?
To achieve high quality visual standards for the siting of major promotion signs.
To ensure that the signs are not detrimental to the appearance of their surroundings or the safe and efficient operation of the route through the application of consistent planning controls.
Will the proposal have an adverse affect on the amenity of Eastlink and will it contribute to visual disorder when viewed from Eastlink
[3] Amendment C61 to the Maroondah Planning Scheme seeks to introduce into the planning scheme policies based on the Maroondah Urban Framework. A new policy about advertising signs is proposed. The amendment has been exhibited and submissions received. The submissions have not been considered by an independent Panel. The amendment has not reached a stage in the planning scheme amendment process whereby it would qualify as a seriously entertained planning proposal requiring me to accord it significant weight.
[4] Partly in response to the Tribunal's findings in the Caption case cited above, Connect East has embarked on a process that it hopes will eventually lead to all municipalities through which Eastlink passes, adopting amendments to their planning schemes that will introduce a common policy basis for the consideration of development (including major promotion signs) on land abutting Eastlink.
I acknowledge the clear merit underpinning a common and strategic approach to the consideration of applications along Eastlink. However, the planning scheme amendment intended to introduce the common policy, is at best embryonic. It has not reached a stage in the planning scheme amendment process whereby it would qualify as a seriously entertained planning proposal requiring me to accord it any significant weight. I was advised that not all municipalities have agreed to amend their planning schemes. Authorisation for the amendment has not (at the time of the hearing) been obtained.
[5] My finding on this point is consistent with the finding of Member Fong in the Caption case.
