Insurance Australia Limited t/as NRMA Insurance v Elmir [2025] NSWPICMP 685
MOTOR ACCIDENTS - Motor Accident Injuries Act 2017; review of medical assessment; gastro-oesophageal reflux disease analgesic gastropathy; medication-induced gastrointestinal motility disorder; whole person impairment (WPI); no direct impact to chest or abdomen; chronic pain in neck, shoulders, elbow, pelvis, and left knee; visceral hypersensitivity of the gastrointestinal tract; constitutional condition unrelated to and completely independent of the motor vehicle accident; gastrointestinal symptoms have not arisen from the motor vehicle accident; no rating for WPI is applicable; medical certificate revoked.
Replacement Certificate issued under s 7.23(1) of the Motor Accident Injuries Act 2017
17 December 2024. 2. The following injury was not caused by the motor accident:
(a) Intestine - Gastro-oesophageal reflux disease, analgesic gastropathy, and
(b) medication-induced gastroinstinal motility disorder.
25 October 2022. Following the accident, the claimant lodged an application for personal injury benefits and thereafter it was determined that the claimant had sustained
non-threshold injuries. 2. The claimant sought a concession from the insurer that his injuries exceeded 10% whole person impairment (WPI). Following a review, the insurer declined to make this concession and consequently, the claimant lodged an application for assessment of WPI. 3. The claimant was examined by Medical Assessor James Cowlishaw on 3 December 2024. In a certificate dated 17 December 2024, he determined that the injuries caused by the motor accident gave rise to an impairment of 5%. That is intestine - Gastro- oesophageal reflux disease, analgesic gastropathy and medication induced gastrointestinal motility disorder. 4. The insurer sought a review of this determination, and in a certificate dated 2 April 2025 President's Delegate Ratula Gupta determined that there is a reasonable cause to suspect that the medical assessment is incorrect in a material respect. The matter has now been referred to this Medical Panel. 5. Directions were issued to the parties to upload all material which was before Medical Assessor Cowlishaw, and this has now been done. 6. The Panel convened on 23 June 2025 and determined that it was appropriate to re-examine the claimant by audiovisual link as there is a need to clarify the claimant's history. Thus, arrangements were made for the claimant to be seen over Microsoft Teams by Medical Assessor Sethi on 4 August 2025.
(a) Mobic 2 tablets daily;
(b) Nexium 20mg daily;
(c) Panadeine forte 2 tablets daily;
(d) Nurofen as needed (once every few days), and
