1 cited instrument linked from this judgment.
The Industrial Relations Commission approved a union-employer agreement to vary the L.P. Gas Industry Award 1985. The agreement provided for modernising the award and allowing employees to perform a wider range of duties, including tasks related to their main work. The Commission found this satisfied the 'structural efficiency principle' from the National Wage August 1989 decision, which encouraged workplace reform in exchange for wage increases. The award was varied accordingly, with the changes taking effect from the next pay period after 14 June 1990 for six months.

COMMISSIONER JOHNSON
MELBOURNE, 14 JUNE 1990
Wage rates - National Wage August 1989 structural efficiency principle - agreement includes award modernisation, wider range of duties for employees - application granted.
In this matter the applicant is the Federated Gas Employees Industrial Union (FGEIU). The union seeks to vary the above award in the relation to structural efficiency. The application is by consent and made in part settlement of the dispute found to exist in C No 5077 of 1985.
The parties agreement makes provision for award modernisation and performance by employees of a wider range of duties, including work which is incidental or peripheral to their main tasks or functions.
In all substantial respects the parties' agreement is the same as those concluded by the employer with the Transport workers Union of Australia in relation to the Transport Workers (LP Gas Industry) Award 1985, and the Gas Industry Salaried Officers Federation in relation to the Gas Industry Salaried Officers (LP Gas Industry) Award 1985.
When this matter was before me on 28 March 1990 I said, at the conclusion of proceedings, -
"I have formed the view that the agreement is consistent with the requirements of the structural efficiency principle. In relation to payment of the first instalment, subject to receipt of a draft order
within seven days, the Commission will vary the award in terms of the parties' agreement to reflect their commitments. The Commission's order will take effect from the beginning of the first pay period to commence on or after today's date and remain in force for a period of six months thereafter".
Application granted. The Commission varied the L.P. Gas Industry Award 1985 in terms of the parties' agreement. The order took effect from the beginning of the first pay period to commence on or after 14 June 1990 and remained in force for six months thereafter.
