[1995] AIRC 2455
defendant. Application granted. The three applicant organisations were recognised as a federation under the name 'Federation of Professional and Managerial Employees'.
Three unions—the Association of Professional Engineers, Scientists and Managers, the Salaried Pharmacists' Association, and the Association of Railway Professional Officers—applied to be recognised as a federation so they could later formally merge. The Industrial Relations Commission found that they had met all the legal requirements, including showing they genuinely intended to amalgamate, and approved their application to be recognised as the 'Federation of Professional and Managerial Employees'.

The application and the proposed rules of the FPME as lodged each contained one minor typographical error. Pursuant to s.111(1)(p) of the Act, the Commission allows:
1 cited instrument linked from this judgment.
1.the application to be amended by the deletion of the word "THE" from the description of the ARPOA appearing next to the signature of its General Secretary, and
2.the proposed rules of the federation to be amended by deleting from Rule 6(a) the word "year" where it appears for the second time.
Each organisation has carried a resolution at an appropriate level supporting the intended amalgamation of the three organisations (Exhibits APESMA 1, APESMA 2 and ARPOA 1).
Having considered all the material now before it and the submissions made on behalf of the applicant organisations, the Commission is satisfied:
that the APESMA, the SPA and the ARPOA are intending to pursue a formal amalgamation under the Act and are "existing organisations of employees concerned in a proposed amalgamation" for the purposes of s.236(1) of the Act,
that the requirements of s.236(2) of the Act and Regulations 64(1) and (2) have been met, and
that the three organisations intend to lodge an application under s.242 of the Act in relation to their proposed amalgamation within the prescribed period.
I therefore grant the application of the applicant organisations for recognition as a federation under the Act.
