1. On 28 October 2011 the applicant, Serena Holmes, appeared before me applying for bail. The applicant is subject to one charge of trafficking in a controlled drug other than cannabis, namely methylamphetamine, which is currently pending in the Magistrates Court. I understand the applicant entered a plea of not guilty to that charge, and the matter is listed for a case management hearing.
2. The applicant was arrested on 30 September 2011 with respect to the charge. Counsel for the respondent, the informant in the Magistrates Court proceedings, indicated that bail would not be opposed if this Court had jurisdiction to hear the bail application.
3. It was the respondent's submission that this Court did not have jurisdiction to make a bail order as the provisions of of the (ACT) (the Act) were not satisfied. This section provides:
