SUPREME COURT OF THE AUSTRALIAN CAPITAL TERRITORY
Case Title: In the application of Grewal Citation: [2026] ACTSC 367 Hearing Date: 18 September 2026 Decision Date: 18 September 2026 Before: Muller J Decision: (1) Amandeep Singh Grewal is appointed as a notary public under s 7 of the Notaries Public Act 1984 (ACT). Catchwords: CIVIL PRACTICE AND PROCEDURE – NOTARY PUBLIC – Application to be appointed as a notary public – principles – procedural requirements Legislation Cited: Notaries Public Act 1984 (ACT), ss 4, 5, 7, Sch 1 Parties: Amandeep Singh Grewal (Applicant) Representation: Counsel Self-represented (Applicant) Solicitors Self-represented (Applicant) File Number: SC 340 of 2026 MULLER J: Ex Tempore Remarks (Revised)
Amindib Grewal applies for appointment as a notary public pursuant to the Notaries Public Act 1984 (ACT) (the Notaries Act).
In support of the application, he reads his own affidavits affirmed on 5 August 2026 and 11 September 2026. He has tendered in support of the application a letter from the ACT Law Society dated 19 August 2026 and an email communication on behalf of the Attorney-General of the ACT dated 25 August 2026, each indicating that those bodies have no objection to the application that is made.
Section 4 of the Notaries Act identifies the eligibility criteria for appointment as a notary public: (a) holds a current unrestricted practising certificate; and (b) is competent to act as a notary public; and (c) is of good fame and character.
Section 5 of the Notaries Act relevantly identifies how an application must be made: … (2) An application under this section— (a) must set out fully and clearly the facts relied on to establish that the applicant is eligible to be appointed as a notary public; and (b) must be verified by the affidavit of the applicant. (3) An application under this section must not be set down for hearing on a date that is earlier than 1 month after the day the application is filed. (4) An applicant must, within 2 business days after filing an application under this section, serve a copy of the application, together with a copy of the affidavit verifying the application, on the Attorney-General and on the law society. (5) An applicant must give public notice of the making of an application under this section not later than 7 days after the day the application was filed. …
I have considered the material that has been filed and tendered in support of the application. I note it meets all of the procedural requirements of s 5 of the Notaries Act. As to the elements to be satisfied in s 4 of the Notaries Act, Mr Grewal holds a current unrestricted practising certificate in New South Wales. He has told me he practices between the two jurisdictions. The affidavit evidence confirms he has completed appropriate notary public training.
I also have evidence before me from the New South Wales Law Society relevant to the assessment of his good fame and character. Having considered the material as a whole, I am satisfied Mr Grewal holds a current practising certificate, is a person competent to act as a notary public and is a person of good fame and character consistent with the requirements of the Act.
Under s 7 of the Notaries Act, Mr Grewal is required to take an oath or make an affirmation of office in accordance with Sch 1 of the Notaries Act before his name can be entered on the roll of notaries public.
I note at the hearing Mr Grewal gave an affirmation.
