s.185 - Application for approval of a single-enterprise agreement
Application for approval of the Hume Bank Enterprise Agreement 2025 - 2028
[1] Hume Bank Limited trading as Hume Bank (the Employer) has made an application, pursuant to s.185 of the Fair Work Act 2009 (the Act), for approval of a single enterprise agreement known as the Hume Bank Enterprise Agreement 2025 - 2028 (the Agreement).
[2] The Finance Sector Union of Australia (FSU) being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.
[3] The Agreement contain a workplace delegates' rights term at clause 7.7 that is less favourable than the workplace delegates' rights term at Clause 27A of the Banking, Finance and Insurance Award 2020 (the Award). Under s.205A(2), the workplace delegates' rights term in Clause 27A of the Award is taken to be a term of the Agreement. The Employer also provided an undertaking expressly incorporating Clause 27A of the Award to address this issue.
[4] A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement. The undertakings are taken to be a term of the agreement.
[5] Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.
[6] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 24 March 2026. The nominal expiry date of the Agreement is 31 March 2028.
