For the reasons given, I do not regard this proposal as prohibited by the provisions of the planning scheme and I do regard it as an appropriate proposal on its planning merits. Accordingly, I will refuse these applications for review and affirm the decision of the Responsible Authority to grant a permit subject to conditions.

I have already indicated that I will impose a condition in relation to the height of additions above natural ground level.
For reasons given I will not impose a condition requiring screening of the western edge of the proposed new upper level deck.
I do not think that a landscape plan is warranted in the circumstances of this case. In saying this I am rejecting a suggestion that further onsite vegetative screening between the Hooper property and the review site is required to screen or soften views of unduly bulky and allegedly unarticulated walls or for any other reason.
The conditions devised by the Responsible Authority deal with the question of external surfaces and colours. I am content to deal with that topic in that way without imposing a more specific requirement, to include green colouring, suggested by Mr Warfe.
