Renewal Orders confirmed at Directions Hearing on 8 July 2025
"The applicant/ tenant seeks, on renewal, an order for compensation and/or a further rent reduction due to the landlord's alleged failure to repair the residential premises as per the orders of 28 February 2025."
"NOTE 2 - The applicant confirmed today that she no longer seeks an order regarding the Termination Notice issued on 29 April 2025 [for rent arrears] and will lodge separate applications if [she] decides to seek a penalty and/or challenges the Termination Notice issued [on 5 May 2025] for end of fixed term [on 22 September 2025]."
(1) The works were completed on 14 March 2025 and the tenant has tendered no building report stating the repairs have not been carried out satisfactorily. The tenant moved back in on 15 March 2025 and the fortnightly rent should revert to full rent of $2,160 from 15 March 2025.
(2) Alternatively, the works have been substantially completed and any departures and omissions are minor and the tenant is not entitled to a continuing 40% rent increase.
(3) Further, any breaches are a result of the tenant preventing access.
(4) Some structural repairs are not the subject of the Work Order (roof leak, rotten beams and floorboards) and should not be the subject of the Renewal.
(5) Since the Renewal, the landlord's builder has returned to address returned mould and the collapsed ceiling in the corner of bedroom 4.
