Background
- The practitioner was first registered as a pharmacist in NSW in March 1996, having qualified with a Bachelor of Pharmacy from the University of Sydney in 1995. During the period 2017-2019 she was the sole proprietor of Priceline Pharmacy at Gordon NSW (the Gordon pharmacy). She has previously been the sole proprietor of Savemore Discount Pharmacy, Marrickville (Savemore pharmacy), and Bardwell Medical Centre Pharmacy, Castle Hill.
- The Pharmacy Council of New South Wales (the Council) imposed conditions on the practitioner's registration on 9 October 2015. Those conditions were that she must not allow the sale or supply of any scheduled item in quantities greater than two items per person in any pharmacy in which she has a pecuniary interest, and that she authorise the Council to access electronic wholesale records for each pharmacy in which she has a pecuniary interest.
- On 23 June 2017, following an inquiry, the Council made a finding of unsatisfactory professional conduct and reprimanded the practitioner, and imposed conditions on her registration. Those conditions included a condition that she provide access for audits at each pharmacy in which she has a financial interest; complete an approved Ethics course; deliver two tutorials to a panel of Council members by 30 September 2017 and 31 October 2017; and that she deliver to the Council each month the purchase and sale records by each pharmacy in which she has a financial interest of Rhinocort® hayfever nasal spray 32mcg (budesonise), SM 33® oral gel (lignocaine), Combantrin® chocolate squares 24 (pyrantel) and Proctosedyl® ointment 30g (cinchocaine/hydrocortisone) products.
- Those conditions were amended on 11 October 2017 and 13 December 2017 to delete the requirement for delivery of the tutorials.
- On 17 May 2018 the practitioner attended a counselling interview in relation to a complaint involving a dispensing error at Priceline Pharmacy Gordon.
- On 27 July 2018 the Council held a hearing under s 150 of the National Law in relation to compliance with the conditions on the practitioner's registration. The Council imposed conditions on the practitioner's registration that she must not practise as a pharmacist; must not enter any pharmacy in which she has a financial interest; must not possess keys, access codes or cards to any pharmacy in which she has a financial interest; must provide evidence to the Council that she has relinquished all keys, smart cards and access cards to the pharmacist in charge of each pharmacy in which she has a financial interest; and must prepare for, attend, engage with and complete the requirements of the Ethics Counsel Program at The Ethics Centre. Condition 6 was: Within 5 days, must provide evidence to the Pharmacy Council of NSW that the pharmacist/s in charge of each pharmacy in which she has a financial interest are aware of these conditions.
