- MILLHOUSE J. Immediately after the hearing of this appeal, we allowed it, our reasons to be published later. My brothers Duggan and Lander have now written reasons. I agree with them.
- A court does not have the power to increase in any way a penalty from which a defendant appeals unless on an appeal as well by the prosecution. Even if it did have such a power, fairness required that the appellant be warned about what the Court was minded to do, so that he could either withdraw his appeal or argue against any increase in penalty.
