1 The worker, Neil Robert Hawkins, has filed two Notices of Dispute in the Tribunal. The first, dated 2 February 1998 disputed the rejection of a claim for income maintenance for ongoing incapacity from 2 September 1997. That notice of dispute proceeded to Arbitration but the claims agent, CGU Workers Compensation (SA) Pty Ltd, was dissatisfied with the outcome and sought judicial determination by request dated 23 February 1999. Following the filing of that request the worker filed a second Notice of Dispute dated 21 May 1999 disputing the rejection of a claim for the payment of certain s 32 expenses. On 4 June 1999 I directed that the second notice of dispute by-pass Conciliation and Arbitration and joined it with the claims agent's application for judicial determination.
2 At the hearing a book of documents was tendered which included the relevant claims documents, statements of various lay witnesses called at the Arbitration, medical notes and reports of relevant medical witnesses and the Arbitration transcript. In addition I heard the evidence of the worker, Drs Manners and Cocchiaro general practitioners, who treated him and Mr Sandow his treating orthopaedic surgeon. Mr Luke**,** counsel for the claims agent, called Mr Doley, the worker's treating physiotherapist, Drs Bauer and Brooks, two general practitioners who also treated the worker, and Dr Thoo, an occupational physician who examined the worker for the purposes of these proceedings.
