Original judgment source is linked above.
[1] I refer to the nature of the problem stated by Ms Harradine in her application dated 25 October 2022 and the substance of her Points of Claim.
[5] Although initially Ms Harradine alleged that the correct amount was $4,015.45 (a cent higher), as reflected in her Points of Claim, a copy of the relevant tax invoice she provided showed that the correct amount was a cent lower, which was in accordance with the evidence of Mrs Tadic. Given that Ms Harradine did not challenge what was stated in the tax invoice and Mrs Tadic's evidence in this respect, I have taken the correct amount to be the amount I have stated above.
[6] As part of her documentary evidence, Ms Harradine provided a copy of a webpage from Eco Flooring's website which contained the above quoted statements. The respondents did not dispute that Eco Flooring's website had the quoted statements.

[26] In addition to Mr Liu's evidence, among the documents provided by Eco Flooring was a copy of an email from Eco Flooring to Ms Harradine on 13 November 2023 in which Eco Flooring stated that the batch of boards that had been delivered to Ms Harradine was "slightly lighter than the sample boards provided, leading to the slight variation in the embossing".
[27] See ACL (Victoria), s 272 for the types of damages that can be recovered against a manufacturer.
[28] See ss 236 and 237 of the ACL (Victoria) and s 184 of the ACLFT Act (Vic).
