Immediately following the opening by counsel of the Builder's case and before any evidence was called, counsel for the Second and Third Respondents, Mr Stirling, stated that his clients, TS Services and RIA wished to withdraw from the evidentiary stage of the proceedings, reserving the right to make submissions at the end. Mr Stirling was excused from further attendance and thereafter, save for a statement read by a representative of RIA, Mr Wayne Barwood, at the conclusion of the evidence, neither TS Services nor RIA took any further part in any of the proceedings. A witness statement of their common director, Mr Apperly had been filed but they did not call him. At the request of the Applicant's counsel, Mr Whitten, I directed that a summons to witness be issued at the conclusion of the rest of the evidence, directed to Mr Apperly, pursuant to which he attended, produced a number of documents and gave some evidence.
