Introduction
- By notice of motion dated 21 April 2022, the State of New South Wales (the defendant) seeks leave to extend time for the service of a report of Dr Michael Robertson, a toxicologist, dated 24 March 2022 until 25 March 2022. The defendant also seeks leave pursuant to Uniform Civil Procedure Rules 2005 (NSW) (UCPR), r 31.4 to extend the time to serve the witness statement of Senior Technical Officer Christian Halbmeier dated 31 March 2022, to that date. Both applications for leave are resisted by Mr Maconachie QC, who appears with Mr Tierney, on behalf of Andrew Hannam (the plaintiff).
