The Impugned Non-Puffs Works
191 I will now consider whether the Impugned Non-Puffs Works reproduce a substantial part of any of the Applicants' Works. For this purpose, I consider it relevant to consider all of the Applicants' Works, not only the Applicants' Non-Puffs Works. If, for example, one of the Impugned Non-Puffs Works reproduces a substantial part of item 1 of the Applicants' Works, this would be sufficient for the applicants to make out their case.
192 I start with the question of causal connection. On the basis of the evidence and findings set out above, I am satisfied that Motor Design, in designing the Impugned Non-Puffs Works, copied (at least) items 1 and 2 of the Applicants' Works. The documents make clear that Motor Design had access to the packaging for BABY BELLIES Organic Blueberry puffs (item 1 of the Applicants' Works), the packaging for LITTLE BELLIES Organic Animal Biscuits (item 2 of the Applicants' Works), and the packaging for LITTLE BELLIES Organic Gingerbread Men (item 9 of the Applicants' Works). These were three of the six works appearing on the page headed "BENCHMARK" in Motor Design's 30 April 2019 presentation to Aldi (see [83] above). It is likely that Motor Design also had access to the balance of the Applicants' Works, given that it received a link to the website for the BELLIES brand. Further, as set out above, I infer that the process undertaken by Motor Design was to design packaging for the MAMIA snacking range that resembled the packaging of the benchmark product (albeit not too closely).
193 Next, I will consider objective similarity and the question whether each of the Impugned Non-Puffs Works involve a reproduction of a substantial part of any of the Applicants' Works. I consider that it is sufficient to consider the Impugned Non-Puffs Works in three groups (as the works within each group have a very similar design):
(a) the two works relating to MAMIA Rice Cakes (items 1 and 2 of the Impugned Works);
(b) the three works relating to MAMIA Fruit & Oat Bars (items 3, 4 and 5 of the Impugned Works; and
(c) the three works relating to MAMIA Fruit Snack Cereal Bars (items 6, 7 and 8 of the Impugned Works).
194 Further, I consider that it is sufficient to address this question by reference to items 1 and 2 of the Applicants' Works; that is, to ask whether each of the Impugned Works reproduces a substantial part of either item 1 or item 2 of the Applicants' Works. The other Applicants' Works contain similar layout and design features. If the applicants are unable to make out their case by reference to either item 1 or item 2 of the Applicants' Works, then in my view they are unable to make out their case by reference to any of the other Applicants' Works.
195 Starting with items 1 and 2 of the Impugned Works (MAMIA Rice Cakes), I will first consider whether these works reproduce a substantial part of item 1 of the Applicants' Works (BABY BELLIES Organic Blueberry puffs).
196 I consider that items 1 and 2 of the Impugned Works reproduce the following layout and design elements of item 1 of the Applicants' Works:
(a) a solid white background;
(b) a rounded, childlike font;
(c) on the bottom left, a green oblong shape with writing in it;
(d) on the right side, photographic images of the product and ingredients, in a vertical composition; and
(e) a number in the upper-right corner.
197 Unlike the Impugned Puffs Works, items 1 and 2 of the Impugned Works do not reproduce the design element of a small, oval-shaped cartoon character. The owl in items 1 and 2 of the Impugned Works is much larger, and does not resemble the cartoon character in item 1 of the Applicants' Works. While it might be said that a large, light-coloured belly (with writing in it) has been reproduced, I do not consider that this can be considered separately from the character itself, which is not reproduced. Further, unlike the Impugned Puffs Works, items 1 and 2 of the Impugned Works do not reproduce a two-column layout. The ingredients near the bottom of the image stray into the middle of the work, and the MAMIA brand name is central, such that there is not a clear impression of two columns.
198 I am not satisfied that the layout and design elements that have been reproduced, even if taken cumulatively, constitute a substantial part of item 1 of the Applicants' Works. The question is to be approached qualitatively rather than quantitatively. Several of the reproduced elements are commonplace. Further, the combination of these elements does not, in my opinion, produce something that is of sufficient creative significance. I consider that, even if taken together, the reproduced elements lack sufficient qualitative significance to constitute a substantial part of item 1 of the Applicants' Works.
199 I will next consider whether items 1 and 2 of the Impugned Works (MAMIA Rice Cakes), reproduce a substantial part of item 2 of the Applicants' Works (LITTLE BELLIES Organic Animal Biscuits).
200 I consider that items 1 and 2 of the Impugned Works reproduce the following layout and design elements of item 2 of the Applicants' Works:
(a) a large, oval-shaped cartoon character, with a large, light-coloured belly (with writing in it);
(b) a solid white background; and
(c) a number in the upper-right corner.
201 I note that the image of item 2 of the Applicants' Works set out in the Introduction to these reasons may not appear to have a white background. However, it does in fact have a white background (having regard to the physical exhibit).
202 In this case (unlike the consideration of item 1 of the Applicants' Works), I consider that the design element constituted by a large, oval-shaped cartoon character, with a large, light-coloured belly (with writing in it) has been reproduced. Unlike item 1 of the Applicants' Works, item 2 of the Applicants' Works does not include as a design element photographic images of the products and ingredients in a vertical arrangement on the right side of the work. Accordingly, this design element is not included above.
203 I am not satisfied that the layout and design elements that have been reproduced, even if taken cumulatively, constitute a substantial part of item 2 of the Applicants' Works. Although the impugned work reproduces the design element constituted by a large, oval-shaped cartoon character, with a large, light-coloured belly (with writing in it), which may be considered to be a creative or original element, the other elements that have been reproduced are commonplace. While the question is to be approached qualitatively, the number of layout and design elements that have been reproduced can be relevant to the qualitative assessment. Here, the number of elements that have been reproduced is too few to conclude that the layout and design elements that have been reproduced, even if taken together, constitute a substantial part of item 2 of the Applicants' Works.
204 For substantially the same reasons as set out above, I do not consider that items 1 and 2 of the Impugned Works reproduce a substantial part of any of the other Applicants' Works.
205 Accordingly, I conclude that items 1 and 2 of the Impugned Works do not reproduce a substantial part of any of the Applicants' Works.
206 I will now consider items 3, 4 and 5 of the Impugned Works (MAMIA Fruit & Oat Bars). I will first consider whether these works reproduce a substantial part of item 1 of the Applicants' Works (BABY BELLIES Organic Blueberry puffs).
207 I consider that items 3, 4 and 5 of the Impugned Works reproduce the following layout and design elements of item 1 of the Applicants' Works:
(a) a solid white background;
(b) a rounded, childlike font;
(c) on the right side, photographic images of the product and ingredients, in a vertical composition; and
(d) a number in the upper-right corner.
208 Items 3, 4 and 5 of the Impugned Works do not reproduce the design element of a small, oval-shaped cartoon character. The owl in items 3, 4 and 5 of the Impugned Works is larger, occupying nearly half of the work. Further, items 3, 4 and 5 of the Impugned Works do not reproduce a two-column layout. The owl character and the product/ingredients come close to each other and the MAMIA brand name appears in the centre (near the top of the work).
209 I am not satisfied that the layout and design elements that have been reproduced, even if taken cumulatively, constitute a substantial part of item 1 of the Applicants' Works. Several of the reproduced elements are commonplace. Further, the combination of these elements does not, in my opinion, produce something that is of sufficient creative significance. I consider that, even if taken together, the reproduced elements lack sufficient qualitative significance to constitute a substantial part of item 1 of the Applicants' Works.
210 I will next consider whether items 3, 4 and 5 of the Impugned Works (MAMIA Fruit & Oat Bars), reproduce a substantial part of item 2 of the Applicants' Works (LITTLE BELLIES Organic Animal Biscuits).
211 I consider that items 3, 4 and 5 of the Impugned Works reproduce the following layout and design elements of item 2 of the Applicants' Works:
(a) a large, oval-shaped cartoon character, with a large, light-coloured belly (with writing in it);
(b) a solid white background; and
(c) a number in the upper-right corner.
212 I am not satisfied that the layout and design elements that have been reproduced, even if taken cumulatively, constitute a substantial part of item 2 of the Applicants' Works. Although the impugned work reproduces the design element constituted by a large, oval-shaped cartoon character, with a large, light-coloured belly (with writing in it), which may be considered to be a creative or original element, the other elements that have been reproduced are commonplace. While the question is to be approached qualitatively, the number of layout and design elements that have been reproduced can be relevant to the qualitative assessment. Here, the number of elements that have been reproduced is too few to conclude that the layout and design elements that have been reproduced, even if taken together, constitute a substantial part of item 2 of the Applicants' Works.
213 For substantially the same reasons as set out above, I do not consider that items 3, 4 and 5 of the Impugned Works reproduce a substantial part of any of the other Applicants' Works.
214 Accordingly, I conclude that items 3, 4 and 5 of the Impugned Works do not reproduce a substantial part of any of the Applicants' Works.
215 I will now consider items 6, 7 and 8 of the Impugned Works (MAMIA Fruit Snack Cereal Bars). I will first consider whether these works reproduce a substantial part of item 1 of the Applicants' Works (BABY BELLIES Organic Blueberry puffs).
216 I consider that items 6, 7 and 8 of the Impugned Works reproduce the following layout and design elements of item 1 of the Applicants' Works:
(a) a solid white background;
(b) a rounded, childlike font;
(c) on the right side, photographic images of the product and ingredients, in a vertical composition; and
(d) a number in the upper-right corner.
217 Items 6, 7 and 8 of the Impugned Works do not reproduce the design element of a small, oval-shaped cartoon character. The owl in items 6, 7 and 8 of the Impugned Works is larger, occupying nearly half of the work. Further, items 6, 7 and 8 of the Impugned Works do not reproduce a two-column layout. The work is horizontal in shape and there is no clear division between two columns.
218 I am not satisfied that the layout and design elements that have been reproduced, even if taken cumulatively, constitute a substantial part of item 1 of the Applicants' Works. Several of the reproduced elements are commonplace. Further, the combination of these elements does not, in my opinion, produce something that is of sufficient creative significance. I consider that, even if taken together, the reproduced elements lack sufficient qualitative significance to constitute a substantial part of item 1 of the Applicants' Works.
219 I will next consider whether items 6, 7 and 8 of the Impugned Works (MAMIA Fruit Snack Cereal Bars), reproduce a substantial part of item 2 of the Applicants' Works (LITTLE BELLIES Organic Animal Biscuits).
220 I consider that items 6, 7 and 8 of the Impugned Works reproduce the following layout and design elements of item 2 of the Applicants' Works:
(a) a large, oval-shaped cartoon character, with a large, light-coloured belly (with writing in it);
(b) a solid white background; and
(c) a number in the upper-right corner.
221 I am not satisfied that the layout and design elements that have been reproduced, even if taken cumulatively, constitute a substantial part of item 2 of the Applicants' Works. Although the impugned work reproduces the design element constituted by a large, oval-shaped cartoon character, with a large, light-coloured belly (with writing in it), which may be considered to be a creative or original element, the other elements that have been reproduced are commonplace. While the question is to be approached qualitatively, the number of layout and design elements that have been reproduced can be relevant to the qualitative assessment. Here, the number of elements that have been reproduced is too few to conclude that the layout and design elements that have been reproduced, even if taken together, constitute a substantial part of item 2 of the Applicants' Works.
222 For substantially the same reasons as set out above, I do not consider that items 6, 7 and 8 of the Impugned Works reproduce a substantial part of any of the other Applicants' Works.
223 Accordingly, I conclude that items 6, 7 and 8 of the Impugned Works do not reproduce a substantial part of any of the Applicants' Works.
224 I therefore conclude that, in relation to the Impugned Non-Puffs Works, the applicants' case based on ss 36 and 38 of the Copyright Act is not made out.
