(a) On 15 November 2018 the Westpac account ending ...66 for D1 Pty Ltd had a balance of $211,763.93;
(b) On 15 November 2018 a mobile withdrawal identified as "house deposit" in the sum of $150,000 was sourced from this bank account;

7. I have attempted below to give a summary of the dealings between [D1 Pty Ltd] and the purchase of the [Suburb LL property]. I hope to provide more extensive information once I am able to obtain legal representation.
8. The dealings of [D1 Pty Ltd] are very very complex, and I apologise for not been able to provide more detailed information in the time frame stipulated. I have also not been able to provide an updated financial statement.
9. [D1 Pty Ltd] is a company with myself as sole director and shareholder. It has been operating since about 2012. Its functions are very very complex and was involved with [Retail business] holdings, property development, and also managed investments in shares. It operated an investment pool whereby investors could invest into the pool. [D1 Pty Ltd] would then invest those funds into various investments. Dividends were paid based on the performance of the various investments. Withdrawals were managed by either drawdowns directly from the investments, or from incoming investors who would effectively buy the units of investors that wished to withdraw.
19. The bank statements also show how [D1 Pty Ltd] obtained the funds that were transferred for the purchase of the property. As mentioned the investors authorised me to drawdown portions of their investments to use personally. The withdrawals were facilitated by either a direct drawdown from the investment, or a new investor purchasing the units of the old investors.
6. I purchased the property at [Suburb LL] in [late] 2018 in my own personal name. I paid $3 million, $2million was funded through a mortgage with [VV Financial Services Income Fund] and $1m was paid for by myself through funds obtained from my various entities.
(Emphasis added)
3. My parents would like to sell their home and purchase the applicants share of the house from her by consent at a price to be negotiated and agreed by the parties. The proceeds would form part of the marriage pool

consisting of his own funds and those belonging to other people. Mr Gurutze has not had any of the funds returned to him (or to the persons from whom he obtained funds). By paragraph [150] and [152] of Mr Gurutze's affidavit it appears as though he understood that the investments were being made in cryptocurrency. By paragraphs [108] and [109] of Mr Gurutze's affidavit it appears as though he was aware that the husband was not in a position to offer security for the amounts advanced. This conclusion is further reinforced by the fact that Mr Gurutze was the witness to the Deed entered into by the husband and Mr Hadeel.
(a) Interest (or return) on funds advanced (at different rates);
(b) Prompt repayment of capital and interest (or return).
Where the authority to lodge a caveat is given in connection with an obligation by A to pay money to B, and there is no sufficient indication to the contrary, the implication is that the estate or interest granted is an equitable charge to secure payment to B of that money.
(1) A person must not, in trade or commerce, engage in conduct that is misleading or deceptive or is likely to mislead or deceive.
(1) If:
(a) a person (the claimant) suffers loss or damage because of the conduct of another person; and
(b) the conduct contravened a provision of Chapter 2 or 3;
the claimant may recover the amount of the loss or damage by action against that other person, or against any person involved in the contravention.
Thus, the applicable principles as they apply to s 18 of the ACL can be summarised as follows:
a) There is no need to establish an element of fault or intention in the defendant's conduct;
b) The words in s 18 should be given their plain and natural meaning and should not be understood in some loose or expanded sense;
c) It is not necessary to prove that the conduct actually misled or deceived;
d) It is not enough to establish that the conduct was confusing;
e) The court must decide objectively that the conduct was misleading or deceptive or likely to mislead or deceive;
f) Consideration must be given to the particular class of persons who are likely to be affected by the conduct, and that includes the inexperienced and the gullible;
g) The protection provided by s 18 may not extend to a person who fails to take reasonable care of their own interests;
h) The conduct of the defendant must be viewed as a whole and it would be wrong to select some words which alone would be likely to mislead when in their context were not capable of misleading; and
i) The alleged conduct must also be considered in the light of the relevant surrounding facts and circumstances.
(a) The husband engaged in conduct which contravened the ACL when he sent messages promising substantial financial returns;
(b) The scheme was a purported investment, which accordingly falls within the ambit of the expression "trade and commerce";
(c) The husband's conduct conveyed the message to Mr Gurutze that the capital would be returned in a week, together with a sizeable return on the investment;
(d) This message was (whether deliberately or otherwise) misleading.
The damage which Mr Gurutze suffered was the loss of his funds ($600,350). I will make an order that the husband pay damages to Mr Gurutze in the sum of $600,350.
1. Declare that the Defendant is indebted to the Plaintiffs via a Secured Loan Agreement dated [late] 2018 in the amount of $950,296.27 being:

[Ms Hamdan] - they can take it from his share. I didn't take money from anyone. Why is he telling me?

[Y] identified feeling happy when each of her parents. She later clarified that she "pretends" to be happy when with her father and she is "normal" and "happy" when with her mother. ...he witnessed his Dad always yelling and saying that he was married and had another child and he punched his mother and pushed her over the couch. His father got the car key, and he held the dining chair and tried to hit his mother with them and he stated that he saw his mother being assaulted and grabbed by the neck pushing her to the floor and the stepmother called the Police. His father and stepmother tried to choke his mother by pulling the scarf from her head around her neck causing her to choke. She ended up being bruised around her head and neck and broke her tooth.
Evidence about the father's current state of health
(a) Bipolar affective disorder;
(b) Generalised anxiety disorder;
(c) Substance abuse/misuse (substance use disorder);
(d) Hallucinatory incidents (described by the father as delusions).
(a) In 1997 he was charged (and in 1998 convicted) of alcohol related offences.
(b) In 1998 the father was charged (and in 1999 convicted) or driving under the influence of a drug and unlawfully possessing a prescribed restricted substance.
(c) In 1998 the father admitted to self-administering painkillers and sleeping medication and voluntarily relinquished his professional authority.
(d) Between 20 May 1998 and 13 June 1998 the father self-administered unprescribed medication.
(e) On 18 June 1998 a psychiatrist assessed that the father presented with a history of medication dependence and abuse.
(f) On 9 August 2001 the Professional Board suspended the father registration until 2001, when it was renewed with conditions.
(g) On 18 July 2004 the father says nine doctors were supplying him with prescription medication.
(h) In June 2005 the father presented falsified prescriptions to pharmacists.
(i) On 25 February 2009 a trace of morphine was found in the father's urinalysis.
(j) In December 2015 the father's professional authorities were withdrawn due to his use of forged prescriptions.
(k) In 2015 the father was charged (and in 2016 convicted) of driving a vehicle with an illicit drug present in his blood.

[Mr Alzahrani] does have a history of mental health issues. However, it is important to clarify that his condition has been consistently stable and well-managed throughout my care. He has demonstrated excellent adherence to his prescribed pharmacotherapy and continues to engage consistently with both psychological and psychiatric care. His progress reflects strong personal insight and an ongoing commitment to maintaining his mental wellbeing.
...Since assuming responsibility for his care, I have observed no indication of psychiatric decompensation. [Mr Alzahrani] has remained emotionally stable, responsible, and well-functioning in all aspects of his daily life.
...In my professional opinion, [Mr Alzahrani]'s mental health condition is stable and well-managed. It is my view that his psychiatric history shou1d not be misrepresented or used to undermine his capacity to maintain a meaningful and responsible parental role.
(a) It is not clear how much collateral material was available to the author;
(b) The author was not available for cross-examination;
(c) The author of the letter included in his letter the following paragraph:
Significantly, [Mr Alzahrani] is a devoted and caring father to his five children: [Mr V] (17 years), [W] (13 years), [X] (12 years), [Y] (7 years), and [Z] (6 years). Throughout our consultations, he has consistently prioritised their wellbeing, expressing sincere concern and active involvement in their lives. From a clinical standpoint, there is no evidence to suggest that his mental health impairs his ability to provide safe, stable, and nurturing care.
Had the ongoing psychiatric treatment been imposed as a condition of contact, then, in our view, on the evidence available to her Honour such an order could well have been upheld. However, the form of the order leaves it free standing, and in our view it does not comfortably fit within any of the heads of power that we have identified. In those circumstances we ordered that order 13 be set aside.
(a) It will be important for the children and father to spend time on consolidation of the parent/child relationship in a non-supervised setting post order;
(b) It is not clear to what extent Y and Z witnessed the serious incident between Ms JJ and their mother - which has been highly influential in the older children's approach to Ms JJ;
(c) The older children's accounts to their counsellors suggest that Ms JJ has not been cautious to stay away for the whole of the children's time in the past leading to upset.
I certify that the preceding three hundred and eight (308) numbered paragraphs are a true copy of the Reasons for Judgment of the Honourable Justice Christie.
